I agree with everything you said.

However, this isn't even a case of the underage girl giving consent. According to the transcripts, she kept saying "No"

Whoopi was harping on the fact that he PLEAD to a lesser crime. Well of COURSE HE DID ! That's always the point of a plea bargain, is to get charged with a lesser crime. What someone PLEADS to in a plea bargain, and what they ACTUALLY did, are usually to different things.

The fact that the victim now wants to forgive him, doesn't alter the fact that over 30 years ago, she said "No". And she was given alcohol and quayludes to incapicatate her.

I have no sympathy for the guy, I don't care what kind of artistic genious he is, he's also a child rapist who escaped justice.

Bleah !

Absolutely!  I actually clerked for a criminal trial judge my first year out of law school and it was occasionally shocking to see some of the deals people were able to make with the prosecutor's office. 

Nothing along the lines of child rape being reduced to something as minimal as what Polanski plead to, but still, pretty surprising.

And I agree with you, the victim's forgiveness has nothing to do with how the State should be responding.  Our system of justice does not work on the principle that victim's wishes trump the criminal code, sentencing laws, etc.  While I feel badly for her in the sense that this has endlessly dragged out over the past 30 years due to his continued fugitive status, the State can't and shouldn't just say, "well, ok, we'll drop the matter because you asked us to."

Bleh.  I am so tired of hearing people defend him because hes talented and brilliant .  You know, so were Ted Bundy and Adolf Hitler! That doesn't erase or mitigate in any way the atrocity of the crime.

Yeah, I haven't heard one valid reason why this guy shouldn't serve his time.

That is the American Way! Lock someone up in prison for life for stealing a loaf of bread, but let a rapist go free? Ha! What a country. No wonder this country is the way that it is ...BACKWARDS!
