I am firing my lawyer and handling the case myself (pro se).  I had a consult with an attorney who feels my case is being handled badly.  My atty is very well respected, but he is a criminal attorney now.  He is only continuing to handle my case because I have been with him for 12 years.  I think he's burned out and can't be bothered.  I think he's bodged it, frankly.

So I am meeting with another attorney today to get legal advice and ask her to be my "back up" if I find myself in over my head.  Monday, I will fire my attorney and send a letter to the opposing counsel invoking the current CO and refusing any non-CO'd visitation.  I think that will move things forward rather quickly.

I think that's a really good idea.  Good luck.  I hope you get a great resolution very quickly.

Update:

Things are going as well as can be expected, given the level of crazy Ex engages in.

I have filed a Motion and Order to reinstate the case, which was signed by my favorite judge (I cried when I saw his signature.  He HATES Ex, told him, "If I ever see you in my court again, I will lock you up just on principle.")

I filed a Motion and Praecipe for a hearing to modify the CO based on a change of circumstance.  (I am learning so fast)

I file Contempt charges last week and will return for service on Monday and have him served.

Ex has retailiated by "kidnapping" DD (not really, he is interpreting the CO to mean that he has visitation whenever he wants with or without my consent, so he just took her this weekend.)  She called me on Halloween from his house crying, because he had left her home alone and gone to work.

So, whatever, big picture:  He will be smacked hard in court.  Scheduling in 2 weeks, and his attorney is refusing to settle (Unethical behavior) and lying about receiving paperwork.  So, I have to drive 30 minutes to hand deliver everything and get it date stamped and signed received. 

Again, his atty is facing Contempt charges and maybe even disbarment!

So, I am waiting this out and realizing that he is just giving me more and more and more ammunition to use against him in court. 

It is sad, but you have to let the dog bite your child over and over in order to prove in court that the dog is dangerous.

You sound like you're on top of things and doing a great job. I'm so glad you got the judge you were hoping for - luckily, we have the same judge for all of our cases - visitation, CS, etc. Same judge we've had since day 1 of our divorce - and he also can't stand XH...

Keep us posted. Sounds to me he's just digging his own grave.
