This is the situation. A relative of BD's makes a generous gift to his DS with BM, the relative only knows his DS with BM and never met his DD with SM. BD feels the gift should be shared between the two children since it was circumstances why the relative never met his DD with SM. BM has accepted the gift and refuses to share it, BM is named as the trustee for her DS.

Is it fair for BD to demand his DD share in the gift?

A person can give a gift to whomever they choose. The recipient may either accept or refuse the gift. It is not their place to critique the gift. In other words BD's relative can give money to whomever they choose, they don't need BD's permission.

No. The relative is free to give the gift to whichever child they wish.

I do think its bad form to give to one and not the other, however, that is the relatives prerogative.

My dad does this kind of thing all the time. He went on holiday earlier this year and bought me an $1300 Louis Vitton bag but didn't buy my brother anything. It's not exactly fair, but its up to him how he spends his money.

Nope.  People are allowed to gift to whomever they want.  If they'd wanted to give a gift to the DD they would have done so.  Instead, they chose to give the gift, in its entire amount, to the DS.  This is their choice and BD needs to deal with it.

I agree.  Even though he's never met DD, I'm sure he knows she exists, and, as harsh as it may sound, if he wanted the gift to be shared, he would have gifted some of it to her.
