Ex's atty has done a "mea culpa" and claimed "clerical error".  I call BS, because my former atty referenced the offer in two letters, and I referenced it in two letters.  I do not believe that it was an accident at all.  He has offered to compensate Ex for his incompetence and wrap up the case for him free of charge.

I am not amused.  I have incurred damages as well.  I want MY apology in writing and I would like to also be compensated for my unnecessary filing fees, driving time, investigative time, copying, etc.

I am glad I got this thing settled (and pretty proud of myself), but REALLY ticked at the mess the lawyers made a relatively simple matter.

I wouldn't be amused either.  Evidently he thinks he's done a good-enough CYA that he won't get caught.  Some lawyers are just ridiculous.  Can't say all - I'm married to one ;)  But now that I think about it, he does a fair game of CYA too . . .  hmm . . .

The thing is he DIDN'T do a good job of CYA, at all!  BOTH of his paralegals were standing there when I asked to see the file, and the settlement offer was right there.  Not misfiled.  He put in writing that he "didn't know anything about" the settlement offer. 

It's absurd how bad of a job he did of it.  It's like he was too arrogant to believe he could get caught.

You should write him a letter stating all of what you've said here.

 - The settlement agreement was served x date. 

 - It was referenced in letters a and b sent on dates x and y.

 - On x date I viewed the file in your presence.  Your paralegals ____ and ____    were present as well. 

etc etc etc. 

Then list your expenses you want to be compensated for.

He might be willing to pay you to make it all go away. (If he's smart, that is)
