School Sued in Online Photo Controversy

INDIANAPOLIS (Oct. 30) -- Two sophomore girls have sued their school district after they were punished for posting sexually suggestive photos on MySpace during their summer vacation.
The American Civil Liberties Union, in a federal lawsuit filed in late October on behalf of the girls, argues that Churubusco High School violated the girls' free speech rights when it banned them from extracurricular activities for a joke that didn't involve the school. They say the district humiliated the girls by requiring them to apologize to an all-male coaches' board and undergo counseling...

I don't think the school went to far. The photos were printed out and brought into the school. The girls were part of the athletic program which has it's on code for conduct for the students in the athletic program. The girls violated that code of conduct and have to deal with the consequences of their actions. If they didn't want to uphold the code of conduct for the athletic program, they shouldn't have been in the athletic program.

This is an issue that's going to come up again and again. No, it's not the school's legal responsibility to uphold moral guidelines when a student is not on campus or at a school-sponsored event. It's everybody's responsibility to protect children from their own stupidity. Unfortunately, the parents failed (or were just not aware, a more likely scenario), so the school stepped in.

Honestly, if I were the clueless parent and my DD did that, I'd be thrilled someone had made an attempt to discipline her and maybe stop her making such an assinine move in the future.

Yes, people have a right to privacy during their own leisure time, but the courts have historically granted minors fewer rights than adults, because they need more protection from their sometimes bonehead selves.  So these girls are going to learn a civics lesson from suing their school, but they're not going to learn what they need to to keep themselves safe in the world. I think that's a loss.

I dont think its the schools job to police my childrens activities during non school hours when it does not directly affect the school in any way shape or form. HAd they been wearing school unifroms..yes. But they had nothing that signified their school affiliation. Therefore the school should step back and allow the parents to punish the girls.

I would be livid if my teen daughter had to apologise to every man in her school b/c she might have turned him on and offended him. That is irrational.

Does every male student who gets caught with porn need to apologise to every female student/teacher?

They had to apologize to the athletic board (which happens to have all men) because they violated the athletic departments code of conduct. If the athletic board was all women, they still would have had to apologize. If the children didn't want to follow the code of conduct for athletics, they could have not participated in athletics and then it wouldn't be an issue, but since they violated a code that states it is a YEAR ROUND policy, they deserve to be suspended from sports.

If my son wants to play sports and has a code of conduct, he has to live up to that agreement. If he doesn't think he can do it or doesn't want to do it, then he won't participate in school sports.
